Abstract

Discusses the provisions of European Parliament and Council Directive 2002/87, the Financial Groups (Conglomerates) Directive, which was due to be implemented in the EU Member States by August 11, 2004, and which comes into effect on January 1, 2005, including: (1) the definitions of a group of undertakings and a financial conglomerate; (2) the requirement that regulated entities in a financial conglomerate have their own funds available to them, and adequate capital adequacy policies in place, at conglomerate level; and (3) the requirement that risk management processes for regulated entities are supervised at conglomerate level. Considers the implications of the Directive for banking and investment business in the EU and in third countries.
