Abstract

Discusses how the European Court of Justice has interpreted Council Regulations 4055/86 and 3577/92 on the application of the freedom to provide services principle to carriage by sea. Considers the scope of Council Regulation 4055/86 as regards Community nationals, the legality of charges on passengers embarking or disembarking, cargo sharing agreements with third countries and the provisions of Council Regulation 3577/92 to liberalise cabotage.
